“Crime is not punished as an offense against God, but as prejudicial to society. - James Anthony Froude,”

The development of computers were the result of advances of the technology. As to the definition of Wikipedia, Computer is  a programmable machine designed to sequentially and automatically carry out a sequence of arithmetic or logical operations. Computers have provided much ease, comfort and convenience to the people but a lot of computer crime arises also because of too much exposure of the device. A crime is an action or an instance of negligence that is deemed injurious to the public welfare or morals or to the interests of the state and that is legally prohibited,as defined in the dictionary.com. When we say computer crime also called as cybercrime it refers to a crime that involves a computer and a network. The computer is being used in commiting a crime or it maybe is the target. The most common computer crimes are hacking, pornography and copyright infringement.

YouTube video maker who threatened judge must stay jailed awaiting trial.

U.S. v. Jeffries, No. 10-CR-100, 2010 WL 3619946 (E.D. Tenn. September 13, 2010)
Defendant created and posted a video to YouTube in which he allegedly sang a song that threatened to bomb the car of a judge scheduled to hear his child custody case. Though he did not mention the judge by name, he said the song was “for you judge” and said “do not tell me I cannot curse.” (The judge had previously admonished defendant for swearing in the courtroom.)
The feds charged defendant with one count of transmitting in interstate commerce a threat to injure and kill.
Recognizing that defendant was a danger to society, the government filed a motion asking the court to order he stay in custody until trial. The court granted the motion.
The court weighed four factors in making this determination. First, the charged offense was a crime of violence (18 U.S.C. 16 defines a crime of violence as one containing an element of threatened use of force against another). Second, the evidence as to defendant’s dangerousness was great — the YouTube video was about killing and car-bombing, after all. Third, the defendant’s character (especially in the past few months) made him a risk — he had attacked a doctor, had alcohol problems, and got kicked out of military housing for firing a weapon during a dispute. Fourth, defendant was a danger to the community and to his family — he was living with his wife and children when he had fired the gun into the air.

Republic Act 8792 is the act “Providing and Use of Electronic Commercial and Non-Commercial Transactions, Penalties for Unlawful Use Thereof, and Other Purposes” enacted by the Congress of the Philippines and approved by the President on June 14, 2000.

Section 33a states that Hacking or crackling with refers to unauthorized access into or interference in a computer system/server or information and communication system; or any access in order to corrupt, alter, steal, or destroy using a computer or other similar information and communication devices, without the knowledge and consent of the owner of the computer or information and communications system, including the introduction of computer viruses and the like, resulting in the corruption, destruction, alteration, theft or loss of electronic data messages or electronic documents shall be punished by a minimum fine of One Hundred Thousand pesos (P 100,000.00) and a maximum commensurate to the damage incurred and a mandatory imprisonment of six (6) months to three (3) years;

-->
This feature of RA 8792 is, in my opinion, is the least followed and the least enforced of all the provisions of this law. Cracking (even hacking in some experts on computers) has become widespread nowadays with the exponential growth in technology. A lot of “cracked” and “cracking” software are now available for use and download and no one’s convicted for it. A lot of people don’t also know this law since many don’t have the fear of doing the acts stated in this provision. The government should make the people aware of this particular law since the availability of computers has spread throughout the nation. The people should also abide with this law as responsible citizens and in order to avoid punishments. There aren’t much documented cases regarding this particular feature.

Do You Have the Courage to Live Life?

Who do you think is more courageous in facing an enemy with a machine gun, Superman or a normal soldier?

Superman does not need courage to defeat the enemy because he is invulnerable to bullets. He knows he won't get hurt. On the other hand, a normal soldier needs a lot of courage to take down the enemy. He knows he can lose his life going against this enemy. Courage is when the soldier decides to fight the enemy even if he is shaking in his boots.

You don't need courage in front of a tree. You need courage in front of a bully. Courage can only be practiced under fire.

Courage is not the absence of fear. It is overcoming your fear in front of danger. It is also taking a risk for the sake of the good.

You can never pursue your dreams without courage. Only courage can silence our fears. A lot of people have been crippled because of their fear of failure and getting hurt. Fear continually robs them of their dreams. Fear has made them mediocre, helpless and worst, hopeless.

Only courageous people can go against the river, cowards are swept away.

Courage can make the difference between your mediocrity and greatness.

You can never be great sitting on your butt waiting for the perfectly safe moment or opportunity before you act. It will never happen.

You need to have the courage to take risks if you want to go anywhere in life.

"If you don't take risks for God, you won't give anything worthwhile." - St Louis de Montfort

Mountain climbers risk their own safety to see the beautiful view at the peak. It is the same for us. If we want to go beyond mediocrity and experience the peak of life, we must be courageous. We must risk.

FACT: Prostitution is one of the most dangerous professions in the country.

Prostitution, slavery, exploitation and global trafficking are unethical acts, thus violates the formal, written, rigid and much more the divine and moral law which both belong to the non-jural laws. The following websites which are www.findsomeromance.com and www.filipinaeyes.com are clearly up to selling the women to the local and international men. Each website exposes the identity or picture of a woman to attract buyers-the foreigners or local men, because of that, men easily find their match in just a short span of time then to complete the business or transaction they pay. What is acted by the person behind the websites is ideally human trafficking which is punishable by the law. Punishments or sanction must be imposed to those who violates the law to stop these unethical acts.

I think, there is a difference between the mail order brides industry or companies that produce escort services and meeting someone over the Internet in a chat room. In mail order bride industry, woman are exposed and endorsed because someone dictates and manipulates them. Girls are being harassed by somebody so that's why they follow what is being told them to do while on the other hand, meeting someone over the Internet in a chat room is being managed by yourself, You are the one who likes to be part of  that chat room. There, you will have exchanged conversations from time to time which helps to  know each other more and in some cases leads to marriage.

In my opinion, this industry doesn't differ much from arranged marriages that take place in some cultures. In arranged marriage, they are forced to marry without any consent of themselves just like in the mail order bride industry girls can't choose for themselves but instead they are fixed or arranged of whom their partner will be. Female escorts doesn't also differ from prostitution, escorts intention are also unto prostitution.

Albert Einstein: Ethics is Exclusively Human with No Superhuman Authority

If I become part of the VSU team who will formulate a handbook, the policies that I want to be implemented in VSU or just for CS students  like me regarding computing are the following:

  • Every Student must be responsible in exercising his/her rights (e.g. freedom of expression). He/she must be sensitive enough in expressing something with the use of internet (e.g. posting undesirable statements pointing to a particular person, posting irrelevant topics or issues,.. ) for it only serves as an annoyance to everybody and in other cases may result to misunderstanding.
  • Every Student should avoid involving in computer abuse and must not display malicious behavior to fellow students by using equipments such as computers, video cameras, mobile phones and etc.
  • Every Student is encouraged not to visit any prohibited websites.
  • Eating and drinking while inside the laboratory is prohibited.
  • Every Student should respect the privacy of others. Accessing someone's account without any permission must not be practiced.

Disciplinary Actions for the violators of the Policies:
1st Offense: Give a warning
2nd Offense: Report to the higher authorities
3rd Offense and more: Subject for suspension for 1 month or more

With the explosion of the Internet into the most widely used information medium today, the need to study the correct computer ethics has become imperative to our future as computer users. As the technology underlying computers continues to change, so to must our way of going about ethically using computers to further our society. There are many different areas where the study of computer ethics could be considered applicable.
The use of computers in large corporations is just one sector of computer ethics that needs to be fully understood. As computers are essential to the way big business makes their yearly profit, they can also serve to be attracting devices for employees to use as their own personal usage for entertaining themselves. Many people have lost their jobs due to their complete lack of ethical behavior in the field of using their computer at work for strictly business purposes.
There is also the matter of using computers for criminal reasons. Due to the very nature of the information that is transferred through computers, they lend themselves to being targets for disagreeable characters to attempt to act. From implantable viruses to the most advanced hacking software, criminal behavior in relation to the use of computers is a problem that has been addressed (http://www.valid-computing.com/computer-ethics-definition.html).

---> There is a need to study computer ethics to mold the good moral and right conduct of a person and to help every individual acknowledge and distinguish right and wrong. As like what I've posted above, the case there is very much an improper behavior. Abusing the things (e.g. Computers) that let our lives at comfort zone is unethical. Computers should be used not to disturb, distract and destroy people. In that situation, studying computer ethics is much needed to help that person rediscover himself/herself and mold him/her good moral character.

A practice is the way in which you normally handle a specific situation, or the sequence of steps you follow when you want to accomplish something. As defined Natural law is the unwritten law permeating and governing nature as a rational harmony and orderly pattern of different things and events without which the latter would be reduced to chaos and disarray. It is a discipline that every human being must observe and adhere so that the individual and the common good may be realized or attained (Plato). The precepts of natural law are righteousness, justice, equity and fairness (http://www.freewebs.com/kmsolmoro/notes.htm).

---> In the four types of non-jural law, I would choose to practice the Natural Law in the entire existence of my life. I've chosen this law because I like the percepts of this law. It promotes justice, equity and fairness which are so much essential in dealing with the people not just in our country but all over the world.
